Primary residence and capital gains tax on real estate in Luxembourg

The classification of your property as a primary residence is crucial in determining whether the capital gain realised on its sale is taxable.

If your property is your main residence in Luxembourg

  • The capital gain realised is not taxable,
  • You only need to complete the first page of Form 700.

If this is not your primary residence in Luxembourg

When selling a property, there are two possible scenarios depending on the length of time between purchase and sale:

  • Short-term sales: (under 2 years): Profit from the sale is treated as speculative gain and taxed at your regular income tax rate.
  • Capital gains: if the sale takes place after more than two years, the capital gains are calculated by taking into account a revaluation of the purchase price using the legal revaluation coefficients, then taxed at a quarter of the overall rate.

Applicable allowances

  • Every 10 years, a tax allowance of 50.000€ is granted, doubled to 100.000€ for couples who file jointly.
  • In the event of inheritance, a special allowance of 75.000€ applies if the property was the parents' main residence.
